The Tobacco Products Control Amendment Act no. 12 of 1999 (PDF format) seeks to protect non-smokers from the dangers of passive smoking. It therefore makes provision for designated smoking areas in all public places, including the workplace, restaurants, places of entertainment, airports, accommodation facilities and all other public places. In the light of the new regulations, all employers must have a written policy on smoking as from January 1, 2001. Many employers might not know where to start and what steps to follow.
