The Department of Health Files an Appeal with the Constitutional Court

The National Department of Health has formally filed a Notice of Appeal in the Constitutional Court.

The effect of filing this Notice of Appeal is that the judgement of the Supreme Court of Appeal is suspended with effect from today - 22nd December 2004.

The appeal is in response the Supreme Court of Appeal's Monday ruling that granted an order that effectively set aside the medicine pricing regulations in their entirety.

The Department will therefore wish to inform the General Public, Pharmaceutical Manufacturers, Wholesalers Distributors, Pharmacists and Doctors that the pricing regulations are effective and we expect all stakeholders to abide by the regulations until the Constitutional Court makes a final decision on this issue.

This implies that the pricing regulations are as effective as before the judgement of the Supreme Court of Appeal.
